NEWS! Monticello Hills, LLC has withdrawn it's legal action againt The Town of Richfield agreeing that NO Host Agreement is in effect for the Second Special Use Permit. There were no grounds for the success of this action against the town. The Town Board approved a cost of $6,100 to pay for defending this frivilous action at the last Town Board meeting Feb 20, 2017.
On November 18, 2016, Monticello Hills,LLC served The Town of Richfield Lawsuit papers after being unable to negotiate a new Host Agreement with the Town Board as part of the second Special Use Permit. This action is an attempt to force the current Town Board to accept terms agreed to by a previously seated Town Board for the first Special Use Permit which was annulled by previous court rulings.

the State Supreme Court Appellate Division reversed the earlier Supreme Court
decision to nullify the Special Use Permit issued by the Planning Board for the
wind turbine project. Click

decision handed down on 01/21/2014, Acting Supreme Court Judge Donald J. Cerio annulled the second Special Use Permit issued 09/09/2013 by the Town of Richfield Planning Board to Monticello Hills,
LLC to construct six 492-ft wind turbines.Click

On Monday 09/09/2013 the Planning Board voted 3 to 1 approving a second Special Use Permit. Click
